Terms of Service

These Terms govern your use of DailyMark (the "Service"), operated by Korund DOO, registered at 85310, Montenegro, Budva, Mediteranska 31/D7, registration number (PIB) 03017079 ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

DailyMark is a web application for building shift checklists, scheduling staff and tracking task completion across one or more locations.

We may add, change or remove features over time. We will not materially reduce core paid functionality without notice to active subscribers.

2. Accounts and eligibility

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide and for all activity under your account.

You are responsible for keeping your credentials secure and for the staff you invite into your workspace.

3. Plans and billing

The Service is offered on a Free plan with usage limits and a paid Pro plan billed monthly or yearly. Current limits and prices are shown on our pricing page.

Payments for the Pro plan are processed by Paddle.com, which acts as the merchant of record (the seller of record for your purchase). Your purchase is also subject to Paddle’s Buyer Terms, and you can raise billing questions with Paddle or with us.

Subscriptions renew automatically at the price and interval shown at checkout until cancelled. You can cancel at any time before a renewal from the billing page in your account; cancellation takes effect at the end of the current billing period.

If you are a consumer, you may have a statutory 14-day right of withdrawal. How it works, including when the Service starts immediately, is described in our Refund Policy.

4. Acceptable use

You may not use the Service to break the law, infringe others’ rights, send unsolicited messages, or attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.

We may suspend accounts that violate these Terms or put the Service or other users at risk.

5. Your data

You retain ownership of the content you and your staff put into the Service. You grant us the limited rights needed to host and operate the Service for you.

Our handling of personal data is described in our Privacy Policy.

6. Availability and changes

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may perform maintenance and update these Terms; material changes will be communicated in advance where reasonable.

7. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for breach of these Terms. On termination, paid access continues until the end of the current billing period unless otherwise required by law.

8. Disclaimers and liability

The Service is provided "as is". To the maximum extent permitted by law, we exclude implied warranties and our aggregate liability is limited to the amount you paid for the Service in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence, or for death or personal injury caused by negligence.

9. Governing law and contact

These Terms are governed by the laws of Montenegro. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.

These Terms are prepared in English; the Russian and Serbian versions are translations for convenience. If a translation conflicts with the English version, the English version prevails. Questions about these Terms: support@dailymark.me.
